By using this site or placing an order, you agree to these terms.

1. WHO YOU'RE DEALING WITH

The Outdoor Company Company ("TOCC") is a Texas limited liability company. These terms govern your use of theoutdoorcompanycompany.com and any order you place through it. Questions: hello@theoutdoorcompanycompany.com / 817·765·1655.

2. ACCOUNTS

  • You must be 18 or older to open an account or place an order.
  • You're responsible for keeping your password confidential and for activity that happens under your account.
  • Contractor accounts require approval (W-9, resale certificate, insurance, credit check). Net-terms are extended at our discretion and may be revoked.

3. PRODUCTS, PRICING, AVAILABILITY

  • Prices and stock shown on the site are live from inventory but can change without notice. We reserve the right to correct typos or obvious errors.
  • We may refuse, cancel, or limit any order — including for inventory shortfall, suspected fraud, or unreasonable delivery requests.
  • Bulk materials are sold by the cubic yard, ton, or pallet as listed. Actual delivered volume can vary within industry-standard tolerances (typically ±5%) due to moisture, settling, and measurement method.
  • Special-order items (out-of-stock variants, custom blends, quote-only SKUs) ship on quoted lead times and may require a non-refundable deposit.

4. PAYMENT

  • We accept major credit / debit cards through Stripe. Card data never touches our servers.
  • Approved contractor accounts may purchase on Net-7, Net-15, or Net-30 terms. Past-due balances are subject to a 1.5% per month late fee (or the maximum allowed by Texas law, whichever is lower).
  • Texas state and local sales tax is computed at checkout.

5. DELIVERY

Delivery is governed by our Delivery Policy. In short: same-day delivery is available on bagged products and aggregates ordered in stock by 10 AM; sod requires 24–48 hour notice for delivery and is cut fresh from our partner farms. Risk of loss passes to you on delivery to your specified address.

6. CANCELLATIONS & REFUNDS

Cancellations and refunds are governed by our Refund Policy. Perishable items (sod) and dumped bulk aggregates are non-refundable once cut or delivered.

7. CONTRACTOR & SUPPLIER PROGRAMS

  • Featured installer listings on /installers are at our sole discretion. We may remove a listing at any time.
  • We do not charge installers for featured slots and do not collect referral fees from your customers.
  • Approved suppliers are subject to our purchase-order terms, which are issued individually and form part of these Terms by reference.

8. SITE CONTENT

All text, photos, logos, and code on this site are owned by TOCC or our licensors. You may not copy, scrape, or republish substantial portions without our written permission. Product photos for use in a contractor's own quote document are fine; bulk republishing is not.

9. LIMITATION OF LIABILITY

To the maximum extent allowed by law, TOCC's total liability for any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, consequential, or punitive damages — including lost profits, project delay damages, or damage to third-party property caused by improper installation of products we sold you.

10. INDEMNIFICATION

You agree to indemnify and hold TOCC harmless from any claim arising out of your misuse of the site, your breach of these terms, or your installation of products in a manner inconsistent with manufacturer instructions and applicable codes.

11. GOVERNING LAW

These terms are governed by the laws of the State of Texas without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Tarrant County, Texas, and you consent to that jurisdiction.

12. SMS / TEXT MESSAGING

By giving us your mobile number and opting in — at checkout, by texting us, or by asking our phone assistant to text you — you agree to receive text messages from The Outdoor Company Company: order and delivery updates, quotes, payment links, replies to your questions, and, if you opt in, occasional offers. Consent to marketing texts is not a condition of any purchase. Message frequency varies; message and data rates may apply. Reply STOP to cancel, HELP for help, or call 817-765-1655. 13. CHANGES

We may update these terms. Continuing to use the site after a material change means you accept the new terms.
